The Team

The IP & Technology Protection & Enforcement group advises on all types of information technology, data protection, intellectual property and franchising disputes. There is also a strong non-contentious IP element to the practice, and other groups in the firm add commercial and transactional expertise in related areas such as technology licensing, distribution and advertising.

On the IT disputes side, the team acts for a wide range of international IT and telecom suppliers and customers, whether in court or arbitration proceedings or in a more informal ADR forum. Data protection litigation includes follow-on claims in the wake of data breaches, as well as standalone disputes between data controllers, data processors and/or data subjects working closely with Fieldfisher's leading Privacy, Security and Information group. The IP disputes work covers the full gamut of IP litigation. On the franchising side, we are part of a top tier team acting for leading brands in the retail and hospitality sectors globally. Our clients in all of these areas are often international.

We wish to recruit a high calibre Associate, experienced in commercial litigation, to join our IP & Technology Protection & Enforcement team. This role would suit someone who has an interest in IT and data protection litigation and wishes to specialise in these areas, or someone who has previously had some exposure to them and would like to build upon this. Experience of the franchising sector would be a bonus.

The London team of our IP & Technology Protection & Enforcement group comprises 9 partners and 19 other fee earners. The group works closely not only with complementary groups in our three English offices, but also with the IP/Tech groups in our offices around the world.

Responsibilities

This role will involve two core components: substantial disputes arising out of IT and telecommunications contracts; and prominent data protection disputes and related cybersecurity matters. They will be acting for major IT suppliers, disruptive tech businesses, leading UK telecommunications operators, household global brands in the retail and hospitality sectors as well as public sector clients.

Working closely with the partners and involving high levels of direct client contact, you can expect the role to include:

* Corresponding directly with clients, counsel, expert witnesses and third parties;

* Key contributions at all steps in the dispute resolution process including: evidential analysis, briefing counsel, attendance at mediation, disclosure, producing witness statements and expert reports, ADR and trial;

* Involvement from the outset in marketing, the writing of articles and other business development activity;

* Working self-sufficiently when needed but also thriving as part of a team;

* Participating in external industry/sector organisations.

Key Skills & Experience

* Undergraduate degree (or equivalent), minimum 2:1 and LPC;

* Minimum of 2 years' post-qualification experience in a City firm or equivalent;

* Relevant ‘hands-on’ litigation experience, ideally gained in England;

* Prior experience in technology litigation, contentious data protection and cybersecurity matters and IP disputes would be an advantage;

* Genuine interest in relevant sectors such as media, telecoms and technology is also important;

* Familiarity with High Court process and arbitration rules;

* Excellent organisational/time management skills;

* Reliable and professional manner;

* High standards of client service and responsiveness.
