International firm with a commercial presence are looking for an experience solicitor or legal advisor with at least 5 years experience with no upper limit to advise on compliance and regulatory in the Birmingham office

  • Acting as a key contributor and member of the General Counsel Team.
  • Taking a lead role on communications and presentations to the wider business.
  • Leading on key strategic firm-wide priorities as defined by the GCT, such as compliance with data protection legislation.
  • Advising the business, working with and supporting the Leadership Team and General Counsel, on the compliance/regulatory implications of proposed business critical developments (e.g. merger, overseas offices), and devising and implementing actions to ensure compliance;
  • Advising the General Counsel in their capacity as Compliance Officer for Legal Practice (COLP) on complex business critical regulatory and legal issues, and deputising for them when required;
  • Advising the Money Laundering Reporting Officer in relation to suspicious activity reporting, source of funds issues, and on-going compliance obligations imposed by the Money Laundering Regulations 2007 and Proceeds of Crime Act 2002, including dealing with law enforcement agencies;
  • Providing support, advice and assistance to partners, fee earners and Business Services on all aspects of conduct and compliance (including anti money laundering) as well as complex business critical regulatory and legal issues with a view to providing practical compliance led solutions;
  • Deputising for the Head of Compliance on key projects/issues, and deputising when required.
  • Liaising and collaborating with the Support Directors of the business (including leading for the Compliance team on firm-wide projects) to ensure that business support solutions take account of general risk principles and are compliant with regulatory, legal and professional obligations.
  • Supporting the overseas offices to ensure compliance with the SRA Overseas Rules 2013 and local jurisdictional obligations, including dealing with the relevant local and overseas regulatory authorities to deal with reporting obligations and to resolve any specific issues as and when required to ensure that the firm maintains its required regulatory licences;
  • Leading on developing strategies (and implementing those strategies) for all areas of compliance (e.g. anti-money laundering, Terms of Business and the regulation of overseas offices);
  • At the operational level leading on reviewing, monitoring, developing and improving the firm's processes and procedures (e.g. at client/matter acceptance, anti-bribery, and in accordance with the firm's Compliance Plan more generally);
  • Devising & implementing training on business critical issues, whether by written guidance, on-line modules or face to face sessions (including providing compliance training to new starters) in order to comply with criminal law and regulatory obligations, as well as meet the expectations of insurers and ISO 9001 accreditation;
  • Advising and supporting the internal audit function, including evaluating issues raised (including devising corrective action) to improve the performance of the business, reduce the risk of claims, complaints, regulatory action for non-compliance, and meet the objectives of the firm's ISO 9001 accreditation;
  • Reviewing and advising upon (in a solution-led way) the legal, regulatory and professional impact of commercial tender/pitch documentation and bespoke client engagement terms;
  • Providing advice, support, mentoring and training to the firm's central Client and Matter Acceptance Team on complex client identification and conflict/confidentiality issues.
  • Attendance at local and national compliance events to represent the firm, keeping on top of developments in/changes to the profession's regulatory compliance obligations and leading on any action required to ensure compliance.

Key skills and experience

  • A senior qualified lawyer, preferably with significant experience in a regulatory role either in private practice or in post at a regulatory authority;
  • Ability to understand & interpret complex law in a variety of areas drawing on a working knowledge of relevant legislation (such as the Proceeds of Crime Act, Solicitors Act, Data Protection Act, Money Laundering Regulations, International sanctions legislation and the Solicitors Regulatory Authority Handbook) and an awareness of the possible implications/relevance in relation to common law, contract and/or tort;
  • Strong communication skills, capable of delivering complex information to all levels from members of the Executive Board to support staff;
  • Ability to influence at senior levels;
  • Confident and experienced in advising senior lawyers on difficult compliance issues;
  • A wide understanding of business issues so as to understand the firm's goals, and the risks inherent with those goals;
  • The necessary drive and commercial focus to identify practical, compliant solutions to achieve the firm's goals within the regulatory framework, where possible.
