Property Litigation Paralegal

Job Summary

To support and undertake fee earning work for the firm on behalf of clients in general civil litigation with primary focus on property litigation

Fee earner in the Litigation Department

Key responsibilities

Undertake certain elements of fee earning work under supervision including:

Property litigation (main focus)

Property Disputes

Boundary disputes

 Proprietary Estoppel claims

 Rights of Way/Easements

 Eviction of tenants

Landlord and Tenant disputes (residential and commercial)

 Defending claims (for example, when there is no insurance)

 Non-contentious advice

 Debt recovery/rent arrears

 Contractual disputes

 Property Notices

 Dealing with other litigation matters

 Familiarity with the Civil Procedure Rules and ability to use a variety of resources to carry out legal research

(e.g. PLC and other legal databases, hard copy texts)

 Realising importance of time recording and billing procedures

 Ensuring effective time recordings

 Realising importance of regular billing

 Advising upon funding of a litigation claim

File management and client care, including cost estimates and initial meetings

 Importance of being organised

 Using Outlook and SOS for prompts/reminders/diary entries

 Managing clients’ expectations

Compassion for the stress of litigation on clients

 Providing accurate cost estimates

 Pre-action Conduct and Issuing of Court Proceedings

 Discussing pre-action letters and protocol

 The importance of ADR, including mediation

 Drafting of important documents to progress cases e.g. Particulars of Claim and witness statements

 Locating and approaching specialised experts to assist with a client’s case

 Part 36 offers

Providing advice to other departments and teams eg: Commercial property, probate, company commercial.

 Taking instructions, keeping detailed file notes of instructions received and of advice given and of any other attendances upon clients and other parties

 Issuing “Client Care Letters”

 Advising clients as to the progress of matters and updates of costs periodically throughout matters

 Maintaining an adequate and up to date knowledge of the law and practice

 Compliance with the procedures in the Office Manual and solicitors accounts rules

Any other reasonable duties as directed by your manager

Preparing or supervising preparation of & checking Court bundles

 Advocacy in Court where required and appropriate, bearing in mind cost-benefit analysis

 Agreeing and negotiating terms of settlement and other relevant documents

 Checking and signing files prior to closure

 Dealing with fax, email and telephone communications promptly

 Maintaining an adequate and up to date knowledge of the law and practice

Subject to partner approval, giving undertakings in the approved form in specific matters

 Notifying relevant partner as to any complaints received in respect of work undertaken

Supervising other members of the team as necessary

Marketing and development of work – in conjunction with the established Marketing department.

 Attending networking events

 Developing sources of work

 Involvement in marketing strategies and initiatives

 Developing the company commercial webpage and other marketing material for the department

 Cross department working to raise profile and understanding of the work and identify cross-selling opportunities

Account Procedures

Preparation of bills of costs, and obtaining the approval of Accounts of all bills prepared

 Obtaining payment on account from clients

 Requesting cheques

 Obtaining partner’s signature to cheques

 Preparing written requests for bankers drafts

Notifying accounts of incoming telegraphic transfers

 Making request for telegraphic transfers

Notifying accounts of telegraphic transfers requested

 Preparing written request for telegraphic transfer for authorisation

Counting money received from clients as payments in

 Requesting transfer of money between client accounts

 Requesting transfer of money between client and office account

 Referring amendments to cheques and bills to partners for approval and dealing with the formalities for such amendment

 Perusing monthly print outs and taking the required action including ensuring that all client money is placed on deposit when required

 Attending monthly review meetings to report on outstanding bills and disbursements as requested

Knowledge + Experience

Knowledge of civil litigation law


Law Graduate, Level 3 CILEX or above, or equivalent

Skills + Competencies
