Description

The Role

We are looking for a mid-level Associate to join our growing London Financial Services & Regulatory Team

focusing on a wide range of non-contentious, advisory and transactional matters.

Duties include but are not limited to:

* Advising clients on a wide range of matters, with a particular focus on regulatory authorisations, industry documentation, consumer finance, financial crime, compliance investigation, regulatory enforcement and financial litigation. Associates work in a collegiate environment and can expect a good variety of work.

* Associates are given regular and direct contact with clients, with a culture based on associates being given the level of responsibility they are ready for, rather than a PQE based method of work allocation.

* Developing relationships with clients including gaining a good knowledge of the client’s businesses, economic drivers, market and sector requirements in order to ensure advice is relevant and commercial .

* There are regular opportunities for secondments with clients. Posting to other offices under the firm's associate transfer programme is also a possibility.

* Engaging in business development activities and being active in the promotion of the firm and seeking opportunities for new work

* Working as part of a team including assisting with the supervision of junior lawyers’ work, and taking an active part in sharing knowledge and experience with the team

* This is an excellent opportunity for an Associate to join a recognised team and work closely with leaders within Financial Services.

The Team

The London Financial Services & Regulatory team sits within the firm's broader Banking & Finance Practice which comprises over 40 lawyers specialising in 15 distinct practice areas that best match the requirements of our global client base. The wider Banking & Finance practice is noted for its expertise in acquisition finance, securitisation, bank lending, financial regulatory work and project finance, especially advising on bespoke complex transactions and those involving emerging markets.

The Financial Services & Regulatory team currently comprises 1 dedicated Partner, 4 Associates, 1 Professional Support Lawyer and 1 Trainee. The team is also able to call upon support from the Dispute Resolution practice, specialised in financial services disputes, investigations and regulatory enforcement, as well as the wider Compliance and Investigations service line. Our Financial Services & Regulatory team provides integrated regulatory advice in respect of advisory, transactional and contentious regulatory matters spanning the full range of sub-sectors within the wider financial services sector in particular: banking, payments, funds, retail and wholesale investments, insurers and intermediaries, and market infrastructure providers. Within these sectors, the team has an increasing focus on FinTech clients, spanning the full scope of the sub-sectors set out above.

The team's profile and reputation in the market has traditionally been stronger on the contentious side, with the practice having been involved in some of the highest profile contentious regulatory matters of the last decade including LIBOR, FX and the Lehman's collapse. However, the "bread and butter" work for the team on a day-to-day basis tends to consist predominantly of non-contentious advisory work and transactional work. The team works collaboratively with the Dispute Resolution Group and wider Compliance & Investigations Service Line in respect of contentious regulatory matters and investigations.

Examples of current and recent matters include:

* Advising on the application of new and existing UK and EU regulation- including AIFMD, MIFiD2, PRIIPS, PSD2 and IDD. Regulatory change from Brexit is another example. The team recently advised a major US-headquartered G-SIFI on the application of MiFID 2 from a global record-keeping perspective client and has been advising a number of US fund managers on MiFID 2 and PRIIPs.

* Advised Lloyd's of London (the insurance market) on its Brexit contingency plan.

* Advised one of the UK's fastest growing FinTechs on the establishment of an investment firm in order to comply with MiFID 2.

* Advising a G-SIFI on its compliance with the 4th EU Money Laundering Directive.

* The team recently worked on a major due diligence project in respect of a possible Part VII FSMA transfer, Brexit-related, for one of the UK clearing banks.

* Advising two of the largest global card schemes (also FCA regulated payment institutions) on their Brexit contingency plans.

* Advising a leading UK-headquartered life insurance and investment management group on various investigations overseas into potential misconduct and financial crime.

* Advising on two new AIFM authorisation applications to the FCA, in the private credit an real estate funds space.

* Advising a big name FinTech- a retail securities broker dealer- that is establishing operations in the UK

* Advising a major global IT company on a new customer credit and insurance mediation authorisation.

* Advising an AIM-listed company in connection with an FCA investigation into suspected insider dealing by an employee.

* Advising on an ICO by a well known luxury goods brand.

* Advising on and negotiating industry documentation, including general terms and conditions for brokerage, banking, payments and asset management services; investment management and outsourcing agreements.
