The department

Our Construction and Engineering Team is one of the largest in the UK outside of London. The team deals with all aspects of law impacting on the construction industry.

The Tier 1 ranked Construction Team in Chambers 2018 and Legal 500 2018 specialises in all issues arising out of the construction industry, with a particular focus on contentious dispute work. Specialising in Adjudication disputes as well as Court and Arbitration disputes, the Team is led by Andrew Rush and Ruth Sunaway. The Team currently has 18 fee earners and is the largest practice in the Eastern Region.

Purpose of job

This is a fantastic opportunity to join a dynamic market leading team dealing with high quality work. We are looking for a range of lawyers, from NQ through to Senior Associate / Legal Director level to cover a broad range of work.

Depending on the level of experience and qualification the fee earner will work on a variety of matters, typically Adjudication and Court work acting for clients across all parts of the construction industry.

The successful candidate will, as well as being directly involved in fee earning work, be expected to engage fully in business development, marketing of the Team and generally look to continue to explore opportunities to grow the Team.

Responsibilities will include but are not limited to:

* Running and managing files and delegating to trainees and paralegals as appropriate.

* High Court Litigation as well as mediation. Advocacy, where appropriate.

* Supporting the Team Leaders and Senior fee earners on larger and more complex matters.

* Interacting directly with clients and managing their expectations.

* Business Development

Accountabilities

As a Team we act for all areas of the construction industry in two distinct areas: (1) being non-contentious advisory work for banks, funders, employers and contractors; and (2) dispute work for employers, contractors, sub-contractors and suppliers via Adjudication and/or Court work or Arbitration. We specialise in acting for contractors and sub-contractors advising in relation to Adjudication. Examples of leading cases the Team has been involved in are:

Hunt v Optima (Court of Appeal)

ISG Construction v Seevic

Barry M Cosmetics v Merit Holdings

Areas that we advise upon are:

Adjudication

* Advising on all levels of Adjudication from small sub-contactor disputes to large main contractor disputes ranging in value from £50,000 to £multi million.

* Court (High Court / County Court)

* Acting for all parties in relation to Court litigation, typically in the Property and Business Court (formerly TCC)

Arbitration:

Advising all parties involved in the construction industry in relation to arbitrations (UK).

Non-contentious advisory work:

* Acting for a range of developers (typically London or East Anglia based) on a range of developments drafting and negotiating professional appointment, contracts and ancillary documentation.

* Acting for funders on advising on construction documentation as part of wider Real Estate transactions.

Clients we act for in relation to disputes:

* Employers (typically developers owner occupiers) involved in the development of construction works

* Main Contractors turnover between £25 million and £500 million

* Sub-contractors turnover between £1 million and £200 million

* A variety of specialist suppliers (scaffolders, crane hire companies etc)

* All other parties associated with the construction industry

Clients we act for in a non-contentious capacity:

* Funders, banks, equity investors on development projects

* Due diligence relating to corporate and property acquisitions

* Employers (developer, owner occupiers, utilities) on proposed development / infrastructure schemes.

Training:

* Providing regular training sessions to clients, targets and professional bodies.

Data Security:

* Ensure you are aware of and comply with all information security policies of the organisation relevant to your business role;

* Report any actual or potential security breaches; and

* Contribute to risk assessment where required.

* All employees have the authority to act to prevent an information security incident from occurring or escalating, where possible.

Qualifications/Experience

* Solicitor / Associate of NQ - 5 years PQE gained wtihin a strong regional or City firm

* Strong academic background.

* A high attention to detail to produce work/ documentation which is consistently of a high standard.

* Depending on seniority, experience of Adjudication and High Court Litigation.

* To have a flexible approach to work to ensure client deadlines are always met and clients are communicated with on a consistent and regular basis.

* Interest in and aptitude for business development.
