Summary of the Adult Social Care Lawyer role:

Sellick Partnership is thrilled to be assisting Barnsley Council in their search for an Adult Social Care Lawyer to join their growing legal team.

Responsibilities of the Adult Social Care Lawyer:

• Making applications to the Court of Protection and High Court, e.g. COP applications around issuing concerning deputyships, welfare and best interests, deprivation of liberty including s21a, judicial review, inherent jurisdiction.
• Providing detailed, accurate advice on the Council's responsibilities under the Care Act 2014, Mental Capacity Act 2005, Health and Social Care Act 2008, Mental Health Act 1983 and associated Regulations and Statutory Guidance.
• Providing legal advice and support across a broad range of areas including, ordinary residence, Data Protection and Freedom of Information, safeguarding, provider failure, section 117 aftercare, 16-17-year-old Deprivation of liberty cases.
• Advising Service Managers and Directors on Adult Social Care policy and procedures.

Experience required for the Adult Social Care Lawyer:

• Qualified Solicitor, Barrister or Legal Executive.
• It's not expected that candidates will have experience of all of the above but exposure to Court of Protection or Mental Health Act advice would be beneficial, training and support can be given to develop within the role.
