Job Description

Construction Solicitor - Partner

My client, a leading London practice is looking to recruit a Partner to lead and develop the firms expertise and capability within Construction.  This will include working across other disciplines to build the business. 

Initially you will be expected undertake an existing caseload, delegating as necessary to team members.  

The Construction practice covers both contentious and non-contentious work, as well as traditional development and contract work.   

The existing team has built up a particularly thriving practice in development finance, both on behalf of traditional lenders and also of funders developers.  This reflects a shift in the market towards finance-related construction. The practice also encompasses all aspects of litigation, arbitration and adjudication both domestically and internationally.  As a result, they provide clients with a complete construction service in a cost-effective way.  Whether the matter is non-contentious or contentious, the emphasis is firmly on getting a good commercial solution for their clients. 

 The lawyers in the team have direct industry experience and can therefore ensure that clients commercial interests come first. They believe that this commercial approach makes their construction team stand out from many of their competitors. 

 The Construction team sits within Property but is also supported by the Firms Litigation practice. The Construction teams clients range from large multi-national corporations to entrepreneurs.  Client matters span from multi-million pound projects and disputes to some international commercial arbitration.  Their lawyers are used to working on complex matters that often involve them undertaking a co-coordinating and facilitating role amongst many parties. 

The current Head of Construction is moving on after many years service. Having helped to create and develop this thriving practice my client, are keen to build on his hard work and commitment by appointing at partner level a construction specialist who can take the practice to its next stage. Candidates are likely to be an existing Construction Partner with a predominantly non-contentious construction background and have built up a wealth of knowledge, expertise and leadership experience ideally from a combination of private practice and in-house although they are happy to consider candidates who do not have any in-house experience. 

 The successful candidate will join and lead this small team (2 senior assistants and 1 junior assistant vacancy) with a view to being part of the significant growth plans for this area of the business.   

With its substantial client base firmly planted in real estate it is essential that my client can continue to call upon a strong Construction Team for support.  Anyone joining Construction now will have plenty of opportunity to develop their career further as a partner within the firm so this role will ultimately offer the potential to progress to equity partnership.  However, there is the immediate need to be prepared to undertake what is already a high degree of fee earning work as well as the ability to network with clients and internal contacts in order to build the practice.  

There will be a high quality caseload involving the following aspects:· 

Provision of non-contentious construction advice and support to both external and internal clients· 

Negotiation of standard form and bespoke construction contracts· 

Drafting bespoke agreements for real estate development projects·

Advising in relation to warranties and bonds·

Provision of construction advice and support to property finance transactions·  

Developing further business for the team.

Person Spec

Qualified non-contentious construction solicitor with at least c 8 years PQE·

Strong technical skills including very sound drafting ability· 

Experience should either have been gained in private practice and/or as an in-house Lawyer in a construction company·

 It is essential that candidates have knowledge of construction procurement and large-scale project set-up. 

 This role is not likely to involve work on PFI or PPP projects·

 Thorough understanding of contract law and familiarity with JCT forms·

 Practical knowledge of adjudication procedures·

 Excellent team leadership skills and the ability to share knowledge and information

 Excellent communication and organisational skills.

 Excellent commercial and networking/marketing skills·

 Creative and innovative in their approach to legal solutions·

 Proven record of high standard of client care·

 Contentious experience will also be very helpful, though not essential. 

 Committed to ongoing continuous professional development
